1. INTRODUCTION

- “Debtor” means any person or entity that owes a debt to a Client.
- “Services” means all debt recovery, credit management, risk assessment, and related services provided by Kredcor.
- “User” means any person who accesses or uses the Website.
- “Personal Information” means information as defined in the Protection of Personal Information Act, 2013 (POPIA).
4. ACCEPTANCE OF TERMS
By using our Website or Services, you confirm that:

5. SERVICES DESCRIPTION
5.1 Commercial Debt Recovery
Kredcor specializes in business-to-business (B2B) commercial debt recovery services. We assist clients in recovering outstanding accounts receivable and improving cash flow through pre-legal and legal collection processes.
5.2 Additional Services
Kredcor also provides:
- Credit management and risk assessment services
- Business profile summaries and credit checks
- Estates and Home Owners Association (HOA) debt recovery
- Dispute resolution and negotiation services
5.3 No Guarantees
While we endeavor to achieve the best possible outcomes, Kredcor does not guarantee the recovery of any debt. The success of debt recovery depends on various factors including the debtor’s financial position and willingness to pay.
6. FEE STRUCTURE AND PAYMENT TERMS
6.1 No Success, No Fee
Kredcor operates strictly on a contingency basis. We only charge fees on successfully collected amounts. There are no upfront fees, administrative fees, monthly fees, or handover fees.
6.2 Collection Fee
Our contingency fee is calculated as a percentage of the amount successfully recovered. The specific percentage will be agreed upon in writing with each Client before commencement of services.
6.3 External Costs
Any external costs (such as legal fees, court costs, or tracing fees) will be pre-approved by the Client in writing before being incurred. These costs are in addition to our contingency fee and will be invoiced separately.
6.4 Payment of Recovered Funds
Recovered funds will be paid either directly into the Client’s designated bank account or into Kredcor’s audited trust account, as agreed with the Client. Funds held in trust will be disbursed to the Client within five (5) business days of clearance, less our agreed contingency fee.
7. CLIENT OBLIGATIONS
Clients engaging our services agree to:
- Provide accurate and complete information regarding all debts submitted for collection.
- Provide all supporting documentation including invoices, contracts, delivery notes, and proof of debt.
- Confirm that all debts submitted are legitimate, valid, and legally enforceable.
- Cease all direct collection activities with the debtor once the account is handed over to Kredcor.
- Promptly notify Kredcor of any payments received directly from the debtor.
- Respond to Kredcor’s requests for information or clarification within a reasonable timeframe.
- Authorize Kredcor to act on their behalf in all collection matters relating to the submitted accounts.
8. TERMINATION AND WITHDRAWAL OF ACCOUNTS
8.1 Open-Ended Agreement
Our service agreement is open-ended with no contractual lock-in period. Clients may withdraw accounts at any time by providing written notice to Kredcor.
8.2 Fees on Withdrawn Accounts
If an account is withdrawn and subsequently paid within 60 days of withdrawal, Kredcor reserves the right to invoice our contingency fee on that recovery, provided our efforts directly contributed to the payment.
8.3 Termination by Kredcor
Kredcor may terminate services and return accounts to the Client if:
- The Client breaches these Terms or any service agreement
- The debt is found to be invalid, disputed with merit, or unenforceable
- The Client engages in conduct that damages Kredcor’s reputation
- Recovery efforts are deemed commercially unviable
9. CONFIDENTIALITY
Kredcor will maintain the confidentiality of all Client information and will not disclose such information to third parties except:
- As necessary to provide our services (e.g., to attorneys, credit bureaus, or debt collection networks)
- As required by law or court order
- With the Client’s prior written consent
10. DATA PROTECTION AND PRIVACY
10.1 POPIA Compliance
Kredcor is committed to protecting personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Our Privacy Policy, available on our Website, provides detailed information about how we collect, use, and protect personal information.
10.2 Data Security

Kredcor’s total aggregate liability to any Client for all claims arising from our services shall not exceed the total fees paid by that Client to Kredcor in the twelve (12) months preceding the claim.
13. INDEMNIFICATION
Clients agree to indemnify and hold harmless Kredcor, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Inaccurate or misleading information provided by the Client
- Invalid or unenforceable debts submitted for collection
- The Client’s breach of these Terms or any applicable laws
- Claims by debtors arising from the Client’s conduct or the underlying debt
14. COMPLIANCE AND ETHICAL STANDARDS
14.1 Regulatory Compliance
Kredcor operates in full compliance with:
- The Debt Collectors Act, 1998 (Act No. 114 of 1998)
- The Protection of Personal Information Act, 2013 (POPIA)
- The National Credit Act, 2005 (where applicable)
- All other applicable South African laws and regulations
14.2 Ethical Collection Practices
Kredcor is committed to ethical debt collection practices. We will:
- Treat all debtors with respect and dignity
- Communicate professionally and courteously
- Work to preserve the Client-debtor relationship where possible
- Not engage in harassment, intimidation, or unfair practices
- Protect and enhance the Client’s reputation throughout the collection process
15. DISPUTE RESOLUTION
15.1 Informal Resolution
In the event of any dispute arising from these Terms or our services, the parties agree to first attempt to resolve the matter through good faith negotiations.
15.2 Escalation
If a dispute cannot be resolved informally within thirty (30) days, either party may refer the matter to mediation or arbitration as mutually agreed.
15.3 Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the courts of South Africa.
16. AMENDMENTS TO THESE TERMS
Kredcor reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website or services after such changes constitutes acceptance of the revised Terms. 17. FORCE MAJEURE
